DON'T CONVERSE—ANNOUNCE
Give up on the idea that you need to engage with every lawyer who serves you with a subpoena.

Unnecessary back-and-forth only wastes time you could spend preparing your response. Instead, send standard communications that set expectations and provide information. A few examples:

  • Don’t ask for an extension. Tell them when you’ll respond
  • Give notice that you expect to be paid for your response and estimate your cost
  • Instead of coordinating delivery, tell the requestor how you’ll make documents available to them

If the next step is up to the issuer, you're done.

Sometimes, you’re waiting for something from the requesting party—for example, you’ve asked for more information or told them they served the wrong corporate entity. Maybe you set a reminder to check the status or plan to follow up with a second message. But if the next step is up to the issuer, why not consider yourself done with it? Particularly since there’s a decent chance you won’t hear from them again, it’s not your job to follow up. If you hear back, work on it then. In the meantime, cross it off your list.
