##### SUBPOENA MANAGEMENT

# What’s In and What’s Out

[Subpoena Manager](https://www.safarisop.com/product/subpoena.html) by Safari optimizes every facet of the response process.

Responding to routine records subpoenas is high-number, low-stakes work. And doing it well is usually more about efficiency than strategy. But streamlining isn’t always just shaving off minutes—it might mean taking a different approach. **As your team plans to get better, here are a few ideas from our customers**.

#### DON'T CONVERSE—ANNOUNCE Give up on the idea that you need to engage with every lawyer who serves you with a subpoena.

Unnecessary back-and-forth only wastes time you could spend preparing your response. Instead, send standard communications that set expectations and provide information. A few examples:

- Don’t ask for an extension. Tell them when you’ll respond
- Give notice that you expect to be paid for your response and estimate your cost
- Instead of coordinating delivery, tell the requestor how you’ll make documents available to them

#### BE DONE WITH IT If the next step is up to the issuer, you're done.

Sometimes, you’re waiting for something from the requesting party—for example, you’ve asked for more information or told them they served the wrong corporate entity. Maybe you set a reminder to check the status or plan to follow up with a second message. But if the next step is up to the issuer, why not consider yourself done with it? Particularly since there’s a decent chance you won’t hear from them again, it’s not your job to follow up. If you hear back, work on it then. In the meantime, cross it off your list.

#### JUST ASK Recouping costs is just a matter of asking.

When we talk about Safari’s invoicing features, someone occasionally asks about legal authorities. If you’re facing a broad request and an e-discovery project, maybe it’s worth researching cost-shifting. But considering the low stakes for “go and get” civil subpoenas, our customers take a different approach: they commit to comply, and they ask that the requestor reimburse their response cost. Usually that cost represents an hour or two of someone’s time and a means of delivery. If the odd issuer says no, you’ve lost nothing by asking. And if you’re like our customers, you have a lot to gain by recouping that cost across many subpoenas.
